环境公益诉讼是提高环境司法保障水平、纠正地方政府“规制执行偏差”以及维护社会公共利益的重要司法制度建设。文章选取2011—2017年地级市与上市公司面板数据,利用双重差分法考察了环境公益诉讼试点对地方绿色创新的影响。研究表明,环境公益诉讼可以使试点城市绿色专利申请量提升7.1%,且该政策作用效果随时间推移而逐渐加强,环境司法制度改革能够有效促进地方绿色创新。地方政府加大环境行政处罚与环境治理力度,公众提高环境诉求是上述发现的实现机理。基于上市公司的微观视角,三重差分结果表明环境公益诉讼能促使试点地区污染企业实现绿色创新的“增量提质”和提高环保投资。异质性分析表明,在环境信息公开以及设立环保法庭的地区和非国有企业与水污染密集型行业中,环境公益诉讼的绿色创新效应更为明显。文章为环境公益诉讼试点的环境治理效果提供了实证依据,对后续环境司法制度建设具有一定的政策启示。
