With the innovative development and in-depth integration of Internet information and communication technology and digital data technology, the new business form, new industry and new model of digital economy with Internet platform as the medium and form has become a new driving force to promote the high-quality development of China’s economy. Data elements have also become an important innovative factor of production and the key to promoting all factor innovation under the digital economy. However, in order to obtain or maintain data advantages, super large platform enterprises establish a “fence garden” through blocking, shielding and other behaviors, so that a large number of data elements stored on the platform cannot be optimized. In order to fully stimulate the development of digital economy and optimize the market-oriented allocation of data elements, platform interconnection has become the key strategy and action direction to break the data barrier between platforms.
In order to find out the potential problems that may affect the optimal allocation of data elements in platform interconnection, the Pareto optimal in legal economics can be used to test whether platform interconnection can realize the optimal allocation of data elements. Through comparative analysis, it can be found that platform interconnection will not only bring benefits to many subjects in the market, but also bring risks to some subjects, because the current data security protection mechanism is not perfect, and platform interconnection may bring data security risks to consumers and operators. Moreover, due to the diversity of data ownership to be determined and the imperfect benefit distribution mechanism, it is difficult to compensate the costs paid by some subjects for interconnection.
The potential risk caused by the lack of mechanism has become a realistic factor that hinders platform interconnection to achieve its due effect. In order to eliminate these obstacles, it is urgent to establish a corresponding data security protection mechanism based on the data operation cycle and according to the actual situation and needs of consumers and operators. Based on proper, reasonable, open and fair data ownership arrangements, we should establish an income distribution mechanism suitable for the value and contribution of data elements, so as to improve the multi-benefit distribution system of data. At the same time, on the basis of improving the current competition law, it is necessary to clarify the applicable provisions between different laws through explicit provisions of the law, and realize the effect of multi-law connection in the process of supervision and law enforcement by constructing a cross-departmental collaborative supervision mechanism. Eliminating the obstacles of platform interconnection through the rule of law will help to promote platform interconnection in a scientific and orderly manner, so as to realize the optimal allocation of data elements in the field of digital economy.
