1045在全球科技竞争日益激烈的时代背景下，突破性创新是培育和发展新质生产力的关键，是实现中国式现代化的重要引擎。作为司法执行改革的重要举措，网络司法拍卖的推行为中国企业在新发展格局下实现突破性创新提供了适宜的外部环境。文章手工整理了各城市人民法院首次在阿里司法拍卖平台开展司法拍卖的时间，进而考察该制度对企业突破性创新的影响及作用机制。研究发现，网络司法拍卖显著提升了企业突破性创新水平。机制分析表明，在企业层面，该制度能够增强债权人保护，提升内外源融资能力，减轻管理层短视倾向；在外部制度环境层面，网络司法拍卖降低了司法地方保护主义，提升了司法执行程序的透明度与公平性。进一步分析显示，网络司法拍卖对突破性创新的促进作用在司法制度薄弱地区、非国有企业及创新基础较弱的企业中更为显著，这显示了其“雪中送炭”式的制度补偿功能。文章从“数字+司法”制度变革视角出发，拓展了企业突破性创新诱因的研究边界，为新时代如何利用数字技术赋能创新驱动发展战略、激发全社会创新活力提供了新的思路与实践路径。
